GIFT CARD REGULATIONS

The Rich Supplements limited liability company with registered office in Warsaw, address: Krucza 16/22 Street, 00-526 Warsaw, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw in Warsaw, XII Business Department, under KRS: 0001017246, NIP: 7011127593, REGON: 524363636, share capital: PLN 505,000, is the publisher of The Gloow gift card and the owner of the online sales service available at www.thegloow.com and the seller in the online store www.thegloow.com.

I. Definitions

The following definitions apply to these Gift Card Regulations. following definitions:

Seller - The Rich Supplements limited liability company with its registered office in Warsaw, address: Krucza 16/22 Street, 00-526 Warsaw, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court for the City of Warsaw in Warsaw, XII Business Department, under KRS number: 0001017246, NIP: 7011127593, REGON: 524363636, share capital: PLN 505,000.

Gift Card - a value voucher, the value of which is equal to the nominal value of the Gift Card, issued to the bearer, entitling to its redemption in the Store. The Gift Card is issued in the form of:

physical - Gift Card issued by the Seller in the form of a plastic pre-paid card;

electronic - Gift Card issued by the Seller in digital form, sent via email. The Purchaser receives the Gift Card in electronic form to the indicated email address in the form of a graphic image of the Gift Card with a barcode and the Gift Card number and PIN; an electronic Gift Card is considered digital content (data produced and delivered in digital form) in accordance with Article 2(5) of the Law of May 30, 2014 on Consumer Rights (Journal of Laws of 2014, item 827, as amended).

Account - A virtual collection of resources and rights assigned to a specific Customer who has fully registered with the Store, used to process placed Orders with logging into the Account, containing the history of orders and returns made by the Customer, Customer's preferences for selected products available in the Store, data on payments, information on discounts granted and the number of points collected from the Customer's participation in The Gloow Club, information on purchased Gift Cards, subscriptions.

Purchaser - a natural person, a legal person or an organizational unit that is not a legal person, to which the law grants legal capacity, having its registered office in the Republic of Poland, who purchased a Gift Card from the Seller.

Gift Card Regulations - this set of rules and regulations governing the purchase and use of the Gift Card.

Store - online sales service operated by the Seller, available to Customers, at www.thegloow.com.

Sales Agreement - an agreement concerning the sale of a Gift Card by the Seller to the Purchaser, against payment of the price plus any additional fees, in particular shipping costs. The Sales Agreement is concluded between the Purchaser and the Seller using means of remote communication, at the moment the Purchaser receives a relevant e-mail message from the Seller, sent to the e-mail address indicated in the Order.

Customer - a natural person with full legal capacity, as well as a legal person or an organizational unit without legal personality, to which the law grants legal capacity, making purchases in the Store using the Gift Card.

Order - Customer's statement of intent expressing a direct will to conclude a Sales Agreement for a Gift Card, made using means of remote communication, specifying the type of Gift Card for which the Customer makes an offer to conclude a Sales Agreement and the Customer's personal data necessary for the possible conclusion and execution of the Sales Agreement.

Any capitalized words not defined above shall have the meaning given to them by the Store Regulations available at www.thegloow.com.

The Gift Card Terms and Conditions set forth the general terms and conditions for the use of Gift Cards issued and distributed by the Seller. In matters not regulated, the Store Regulations available at www.thegloow.com.

II. General Provisions

  1. The Gift Card allows you to purchase the Assortment available in the Store. The Gift Card cannot be used to purchase another Gift Card.
  2. Gift Cards in both electronic and physical versions physical versions are available with the following values: 100 PLN, 200 PLN, 300 PLN, 500 PLN, 1000 PLN and 1500 PLN. The Seller allows the possibility of introducing Gift Cards with other values in the future. Gift Cards values are gross amounts expressed in Polish zlotys. The value of the Gift Card does not include the cost of its delivery.
  3. The Gift Card is not an electronic payment instrument, electronic money instrument or payment card. The Gift Card is not exchangeable for cash or other monetary resources - neither in whole nor in part. The cash on the Gift Card gift card is not subject to interest.
  4. The Seller does not verify the way in which the Customer comes into possession of the Gift Card, thus the purchase transaction using the Gift Card gift card by the Customer is considered valid even if the Customer comes into possession of the Gift Card in an unauthorized manner.
  5. A purchaser transferring a Gift Card to a third party should inform that person that the Gift Card is subject to the regulations of the Gift Card Regulations.
  6. The Seller is not responsible for Gift Cards that are lost or damaged after issuance. The Gift Card is not subject to reservation. The Seller shall be liable if the inability to use the Gift Card is due to reasons attributable to the Seller. In such a situation, the Customer should contact the Seller for assistance.
  7. The Seller makes every effort to ensure the smooth operation of Gift Cards. However, it reserves the right to temporarily suspend the possibility of paying through them in the event of a breakdown or technical upgrade of the infrastructure necessary for the use of Gift Cards.
  8. The merchant is entitled to refuse to accept payment by Gift Cards in the event that:
  1. it has received reliable information that the Customer has come into possession of the Gift Card unlawfully,
  2. has a reasonable suspicion that the Gift Card has been tampered with in an unauthorized manner or forged,
  3. The Gift Card is damaged in a way that makes it impossible to read the data written on it.

III. Purchase of Gift Card

  1. A Gift Card may be purchased from the Store in physical or electronic form.
  2. The purchase of the Card is based on the provisions of the Store Regulations, analogous to the purchase of the Assortment, unless the provisions of the Gift Card Regulations state otherwise.
  3. The purchase of a Gift Card excludes the use of any discount codes, discounts or any other discounts that may reduce the value of its purchase.
  4. The Gift Card is issued on condition that the Purchaser pays and the amount equivalent to the Gift Card is credited to the Seller's account.
  5. Payment for the Gift Card can be made using the available payment methods in the Shopping Cart. Payment is made in accordance with the provisions of the Store Regulations available at www.thegloow.com.
  6. The electronic Gift Card is sent to the e-mail address specified in the Order, and the physical Card is sent to the address specified in the Order. Delivery is made in the manner selected by the Purchaser and specified in the Order. Delivery costs, if charged, are paid by the Purchaser when paying for the Order. Delivery of the Physical Gift Card is made in accordance with the terms and conditions specified in the Terms and Conditions of the Store available at www.thegloow.com.

IV. Rules for the use of the Gift Card

  1. In order to use the Gift Card for purchases in the Store, it is not necessary to create an Account in the Store.
  2. In order to make a Gift Card payment in the Store, you need to enter the number provided on the physical Gift Card, or the code provided after purchasing an electronic Gift Card, into the dedicated "Gift Card Code or Discount Code" field when placing an Order in the Store, and then confirm by pressing the "OK" button. In the case of purchases using the Gift Card, it is not possible to purchase the Assortment on delivery. The value of purchases will be automatically reduced by the amount available on the Gift Card.
  3. The Gift Card balance will be reduced by the amount equivalent to the Order. The balance will be updated within a maximum of one Business Day after the Order is placed by sending a message to the Customer's email address provided when the Order was placed, with a code for the remaining amount.
  4. In the event that the funds accumulated on the Gift Card would not be sufficient to pay for the Order, the Customer is obliged to pay the difference with one of the available forms of payment or with another Gift Card.
  5. The Gift Card can be credited only once. The Customer may use several Gift Cards to make payments while shopping in the Store.
  6. A Gift Card may be used repeatedly, until all the funds available on the Gift Card are exhausted or the Gift Card expires. The nominal value of the Gift Card remaining after a transaction made with the Gift Card may be used by the Customer during the Gift Card's validity period.
  7. Customers may obtain information on the remaining funds on the Gift Card by contacting the Seller by sending an e-mail to kontakt@thegloow.com or by phone at +48 22 250 99 99.
  8. The Gift Card is valid for a period of 12 months from the date of its purchase. The validity of the Gift Card is indicated on the packaging of the Physical Gift Card, and in the case of purchasing an electronic Gift Card the date is indicated in the e-mail. Gift Card is automatically activated at the time of its purchase.
  9. If the right to withdraw from the Sales Agreement is exercised, the payment shall be refunded using the same means of payment that were used in the transaction.
  10. In the case of Order, which was paid with a Gift Card or Gift Cards,
    and then returned (due to the right to withdraw from the Sales Agreement or a resolved complaint),
    The Customer will receive another Gift Card with a value corresponding to the amount taken from the Gift Card or Gift Cards used during payment for this Order.

V. Complaints

  1. Complaints related to the Gift Card should be reported to the Seller at the address:
    16/22 Krucza St., 00-526 Warsaw or at kontakt@thegloow.com.
  2. Notification complaint should include:
  1. name and surname of the reporting person;
  2. information on whether the applicant has a Gift Card;
  3. a description of the situation giving rise to the complaint.
  1. Proceedings complaint takes 14 days from the date of receipt of the complaint. The Customer or Purchaser will be notified of the consideration of the complaint in a manner agreed between the parties. In the case of negative consideration of the complaint, the Seller will notify the Customer or Purchaser submitting the complaint, stating the reasons for this decision.
  2. If the data or information provided in the complaint needs to be supplemented, before considering the complaint, the Seller will ask the Customer or Purchaser making the complaint to supplement it to the extent indicated.
  3. In the case of a complaint regarding a Gift Card damaged to the extent that it cannot be used properly, the Customer or Purchaser is obliged to deliver the advertised Gift Card to the Seller.
  4. After the complaint is filed, the advertised Gift Card is deactivated.
  5. If the complaint is accepted, the Seller will issue a new Gift Card with a value equivalent to the funds accumulated on the advertised Gift Card. The validity period of the Gift Card will be at least equal to the validity period applicable to the advertised Gift Card.
  6. In the case of negative resolution of the complaint, the Seller will reactivate the advertised Gift Card. Upon reactivation of the Card, the value of the funds accumulated on the advertised Gift Card will be equal to the value of the funds on the Card on the date of the complaint. The validity period of the claimed Card is extended by the period of its deactivation.
  7. Detailed provisions on complaints and the incompatibility of digital content with the contract are specified in the Terms and Conditions of the Store available at www.thegloow.com.

VI. Withdrawal from the Sales Agreement

  1. A Purchaser who is a Consumer has the right to withdraw from the Sales Agreement for the purchase of a Gift Card within 14 days from the date of receipt of the physical Gift Card or, in the case of an electronic Gift Card, from the date of delivery of the email with the electronic Gift Card, provided that the funds accumulated on the Gift Card have not been spent before the expiration of the aforementioned 14-day period. The Seller shall verify whether the Gift Card that the Purchaser wishes to return is active, i.e. unused in full, and in the case of a physical Gift Card whether the security features have not been tampered with. If a portion of the funds accumulated on the Card is used, the Seller shall refund to the Purchaser the difference between the value of the payment and the value of the used portion of the funds in accordance with paragraph 6 below.
  2. Pursuant to Article 38 of the Law of May 30, 2014 on Consumer Rights, the right of withdrawal referred to in paragraph 1 does not apply, inter alia, in the case of a Sales Contract:
  1. whose object of performance is a non-refabricated item, produced to the Consumer's specifications or serving to meet his individual needs,
  2. for the provision of digital content that is not recorded on a tangible medium, if the performance has begun with the express consent of the Consumer before the expiration of the deadline for withdrawal from the Sales Agreement and after the Seller has informed him of the loss of the right to withdraw from the Sales Agreement (electronic gift card),
  3. for the provision of services, if the Seller has fully performed the service with the express consent of the Consumer, who was informed before the start of the service, that after the performance by the Seller will lose the right to withdraw from the Sales Agreement.
  1. To meet the deadline for withdrawal from the Sales Agreement, it is sufficient to send a statement to the address: 16/22 Krucza St., 00-526 Warsaw or kontakt@thegloow.com.
  2. In case of withdrawal from the Sales Agreement, the electronic gift card will be deactivated.
  3. In case of withdrawal from the Sales Agreement of the purchase of the Physical Gift Card, the Purchaser is obliged to return the Physical Gift Card with the security intact to the Seller immediately, but no later than within 14 days from the day on which he informed the Seller about the withdrawal from the Sales Agreement.
  4. The Seller will return to the Purchaser no later than 14 days from the date of receipt of the statement the payments made by the Purchaser, and in the case of a Physical Gift Card also the delivery costs. Refund of payments will be made by the Seller using the same means of payment used by the Purchaser, unless the Purchaser has expressly agreed to a different method of reimbursement.
  5. Detailed provisions on withdrawal from the Sales Agreement are set forth in the Terms and Conditions of the Store available at www.thegloow.com.

VII. Personal information

  1. All personal data provided as part of the process of purchase and use of Gift Cards, are processed̨ by the Seller, who is the data controller.
  2. The Administrator does not collect personal data of Customers until the Customer uses the Gift Card to pay for the Order.
  3. For more information on the processing of personal data, including the rights of the data subject, please refer to the Privacy Policy and Cookies Policy available at www.thegloow.com.

VIII. Final Provisions

  1. The Seller reserves the right to change the Terms and Conditions of the Gift Cards for important reasons. By valid reasons is understood, in particular, changes in the functionality of Gift Cards, changes in the technical solutions used, including the procedure for the use of Gift Cards, changes in the law, interpretation or practice of government bodies, and changes in the Regulations of the Store, but only to the extent necessary for the mutual adjustment of both regulations. Gift Cards purchased before the amendment of the Gift Card Regulations shall be subject to the Gift Card Regulations in the version in effect at the time of purchase of the Gift Card.
  2. The Seller will notify the Customer of any changes to the Gift Card Regulations by posting the text of the amended Gift Card Regulations on the Store's website and additional information on the Store's website.
  3. In the event that the Seller suspends or terminates the possibility of purchasing Gift Cards, Customers or Purchasers of Gift Cards purchased up to the date of suspension or termination will be able to redeem them under the existing terms and conditions.
  4. These Terms and Conditions shall come into force on 20.09.2023.
