TERMS AND CONDITIONS OF USING PLUXEE VOUCHERS
§ 1
Regulations - this document defines the rules for the use of Vouchers.
Voucher - electronic bearer voucher with a specified expiration date, issued by The Gloow, entitling the User to redeem it at the Store, composed of a sequence of digits making up the voucher number
Store - the online sales service operated by The Gloow at www.thegloow.com.
Pluxee - Pluxee Polska sp.z.o.o. with its registered office in Warsaw at 53 Rzymowskiego Street, 02-697 Warsaw, entered in the register of entrepreneurs kept by the District Court for the capital city of Warsaw in Warsaw, 13th Commercial Department of the National Court Register under the number 0000033826, holding NIP number: 5222357343, with the share capital of PLN 3,000,000,
User - employee of The Gloow or participant of the SAY REWARD Incentive Program entitled to use the products or services covered by the SAY REWARD Incentive Program or the Select Cafeteria Program organized by Pluxee.
§ 2
1. Vouchers must be redeemed in accordance with the Terms and Conditions and Pluxee regulations available on the Pluxee website.
2. Voucher allows the purchase of goods available in the Store, in accordance with the terms and conditions of the Rules and Regulations of the Store available at https://thegloow.com/pl/content/44-regulamin-sklepu-internetowego.
3. The Voucher can be used within the period indicated on the Voucher, with an expiration date of not less than 12 months from the date of issue to the User.
4. Vouchers are available in the denominations indicated on the Pluxee website. The value of the Voucher is indicated on it and is a gross amount expressed in Polish zloty.
5. Voucher is not an electronic payment instrument, electronic money instrument or payment card. The Voucher is not exchangeable for cash or other funds - neither in whole nor in part.
§ 3
1. In order to make a payment with a Voucher in the Store, you need to enter the code provided on the Voucher, into the dedicated field in the Store's shopping cart "Gift Card Code or Discount Code" when placing an order in the Store, and then confirm by pressing the "OK" button.
2. In the case of purchases using a Voucher, it is not possible to purchase goods on delivery. The value of purchases will be automatically reduced by the value of the Voucher. / If the value of the goods is less than the value of the Voucher, The Gloow is not obliged to refund the difference in value.
3. The Voucher can be used repeatedly until the funds are exhausted or the Voucher expires. If the full value of the Voucher is not used before its expiration date, the funds are not subject to withdrawal and are forfeited.
4. If the value of the Voucher is less than the value of the order, the User is obliged to pay the difference with one of the available forms of payment in the Store.
5. The User is entitled to take advantage of discounts, promotional actions, sales.
6. If the User exercises the right to withdraw from the contract, the refund of payments is made using the same means of payment that were used in the transaction.
7. The User may obtain information on the remaining value of the Voucher by sending an e-mail to kontakt@thegloow.com or by phone at +48 22 250 99 99.
8. The Gloow is not responsible for any loss or damage to the Voucher, from the date of their transfer to the User.
§ 4
1. Complaints related to the use of the Voucher on the Store's website should be reported to the address: 16/22 Krucza Street, 00-526 Warsaw or at kontakt@thegloow.com. For complaints related to the purchase of a Voucher, the User should contact Pluxee.
2. The complaint notification should include:
a. the name of the reporting person;
b. information on whether the reporting person has a Gift Card;
c. Description of the situation giving rise to the complaint.
. Complaint processing takes 14 days from the date of receipt of the complaint. The applicant will be notified of the complaint processing in a manner agreed between the parties. In the case of negative consideration of the complaint, The Gloow will notify the complainant, stating the reasons for this decision.
4. If the data or information provided in the complaint needs to be supplemented, The Gloow will ask the complainant to supplement the complaint to the extent indicated before considering the complaint.
5. If the complaint is accepted, the Seller will issue a new Gift Card with a value equivalent to the funds accumulated on the advertised Gift Card. The validity period of the Gift Card will be at least equal to the validity period applicable to the advertised Gift Card.
6. In the case of negative resolution of the complaint, the Seller will reactivate the advertised Gift Card. After reactivation of the Card, the value of the funds accumulated on the advertised Gift Card will be equal to the value of the funds on the Card on the date of the complaint. The validity period of the claimed Card is extended by the period of its deactivation.
6. Detailed provisions on complaints and the incompatibility of digital content with the contract are specified in the Rules of the Store available at www.thegloow.com.
§ 5
1. All personal data provided as part of the process of using the Voucher, are processed̨ by The Gloow, which is the data controller.
2. The Administrator does not collect personal data of Users until they use the Voucher to pay for the order.
3. For more information regarding the processing of personal data, including the rights of the data subject, please refer to the Privacy Policy and Cookies Policy available at thegloow.com.
§ 6
1. The Terms and Conditions are available on the Store's website.
2. In matters not regulated, the rules of the Store and the rules of the gift card available on the Store's website shall apply.
3. These Terms and Conditions may be amended, as long as the amendment does not violate acquired rights, and the possibility of redeeming Vouchers may be terminated. Information about changes or termination of the possibility of redeeming Vouchers will be posted on the Store's website. Amendments to these Terms and Conditions or termination of the possibility of redeeming Vouchers shall come into effect no earlier than 14 days after the date of announcement under the terms specified above. The exact effective date of the changes will be indicated in the notification of the change or termination of the possibility of redeeming Vouchers.
4. The provisions of the Regulations shall be governed by Polish law. In matters not regulated by the Regulations, the provisions of the Civil Code and other laws shall apply.
5. The Regulations shall come into force on 01.02.2024.
